Thermostat mode is not set automatically by Thermostat Scheduler. In general TS mimics the scheduling available for a conventional thermostat, and none of these allowing scheduling of thermostat mode (many use a physical switch). It can be set manually from TS. Also, in general, thermostat mode is changed very infrequently, seasonally, not daily. If you really want to automate changing thermostat mode, that can be done with RM.

I think the driver should be updated to only set the Cooling Setpoint to Heating Setpoint +3° if it is set to less than that (likewise for setting Heating Setpoint to Cooling Setpoint -3°). These may be superfluous settings, as I'm pretty sure the thermostat will do it on its own. I'll check on that, as I have three of them.

Driver already does this. Every setpoint command to Lutron includes both heating and cooling values. It sends the appropriate value based on the current setpoint values.
